Examiner's Report
The Examiner's Report was received on the 2nd February 2022.
As required by the Neighbourhood Planning (General) Regulations 2012 (Regulations 17A and 24A), the District Council will decide what action to take in response to each recommendation made by the report. An appropriate date for this will be agreed with Biddulph Town Council, the qualifying body, in due course.

The examiner has produced his Initial Comments Document and requested responses from the Town Council and District Council by the 17th November 2021.
The examiner sent further queries to the District Council and Town Council on 3rd December 2021 and requested a reply as soon as possible.
A follow up query was also sent to the District Council by the Examiner on the 7th December 2021.

Basic Conditions
Comments received at this part of the statutory process, (Regulations 16 and 23 of the Neighbourhood Planning (General) Regulations 2012) will be forwarded to an appointed examiner, who will assess the Neighbourhood Plan, Neighbourhood Development Order and supporting documents against the "basic conditions". These require that the plan:
- Has regard to national policy and guidance from the Secretary of State;
- Contributes to sustainable development;
- Is in general conformity with the strategic policy of the development plan for the area or any part of that area;
- Doesn't breach or is otherwise compatible with EU obligations - this includes the SEA Directive of 2001/42/EC; and that
- The making of the Neighbourhood Development Plan is not likely to have a significant effect on a European site (as defined in the Conservation of Habitats and Species Regulations 2010(d), either alone or in combination with other plans or projects; and
- Prescribed conditions are met in relation to the order and prescribed matters have been complied with in connection with the proposal for the order.
