Information on street trading and renewing or applying for a new licence or consent

What is street trading?

If you want to sell or offer for sale any item in a street then you must have a street trading licence or street trading consent. 

Street trading is regulated under Schedule 4 of theLocal Government (Miscellaneous Provisions) Act 1982 (opens new window)

Where can I trade?

Currently the only consented street in Staffordshire Moorlands is Derby Street, Leek. Therefore, should you wish to trade in this area a Street Trading Consent is required.

As the responsible authority for granting street trading consent in Staffordshire Moorlands, we will ensure that traders operate in accordance with conditions attached to such consents.

General rules

The maximum number and sizes of pitches shall be as follows:

  • one pitch will be reserved for registered charities only
  • three pitches will be made available for general trading
  • three pitches will be reserved for street entertainers only
  • pitch size will be limited to ensure that safety and the street scene are maintained
  • no more than 6 pitches at any one time
  • the maximum size of any pitch will be 20' x 6' 6" with a maximum height of 8' 4"
  • consents will only be granted in Derby Street between its junction with Russell Street at one end and its junctions with Sheep Market and Stanley Street at the other.
  • we will not grant consent if trading is in direct conflict with goods available from shops in the immediate vicinity.
  • we will not grant consent if it has a detrimental effect on crime, disorder or the local environment
  • if a market pitch is available for the trading purpose it is unlikely that consent will be granted, unless trading is carried out from a trailer outlet that would not be accessible to the market area.
  • if a charity is selling printed news they will not be subject to the above limits provided that they are undertaken by individual vendors not trading from a vehicle, stall or other structure.
  • we may impose a ceiling on the numbers involved in trading activities
  • if a vacancy arises for general trading in this area, and more than one trader applies, the applications will be referred to our Licensing and Regulatory Committee.
